The costs of any mediation or arbitration will be paid by the party bringing the dispute.
Notwithstanding any other provision in these Terms and Conditions, you and Mesazero LLC agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement. Anyone who attempts to sue or obtain an injunction or brings an action in small claims court against the Site for any reason including any content on the Site including user generated content agrees to pay all legal costs for all parties involved including a non-refundable $10,000 fee for costs incurred in defending the Site against litigation.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions.
